Terms of Service

By creating an account on MailSprout (the “Service”) you agree to these terms. The Service is provided by Florida Sound Man LLCd/b/a MailSprout (“we,” “us”).

The service

MailSprout lets you create email accounts on domains you own. You provide the domain and DNS access. We provide the email infrastructure, a dashboard to manage it, and step-by-step tutorials. See the Privacy Policy for a full list of the subprocessors that help us deliver the service.

Your account

  • You must be 18 or older to create a paid account.
  • You're responsible for keeping your sign-in credentials secure.
  • You must only add domains you actually own or have authorization to use.
  • One account per person/organization. Don't create multiple accounts to evade limits.

Acceptable use

Your use of MailSprout is governed by our Acceptable Use Policy, which is incorporated into these Terms by reference and is binding on you as a contract attachment. The full AUP describes prohibited activities, sending limits, opt-in requirements, and enforcement actions in detail.

The summary below is for convenience only and does not replace the full AUP. You agree not to use MailSprout to:

  • Send spam, unsolicited marketing, newsletters, or cold-outreach campaigns.
  • Spoof From headers or send from domains you don't own.
  • Run mailing lists without double opt-in.
  • Use email-warmup services such as instantly.ai.
  • Phish, defraud, impersonate, or distribute malware.
  • Harass, threaten, dox, or target individuals.
  • Violate CAN-SPAM, CASL, GDPR, or other applicable laws.
  • Send sexually explicit content involving minors.
  • Resell MailSprout to third parties without our written permission.

Our mail infrastructure is operated by MxRoute, a service of TuxByte, LLC. MxRoute's terms at mxroute.com/terms (opens in a new tab) apply in parallel and are passed through to you. Where MxRoute's restrictions are stricter than ours, the stricter rule controls.

Violations may result in immediate suspension or termination. We reserve the right to remove content or accounts that violate these terms or that we reasonably believe pose a legal or operational risk.

Sending limits

Each email account is limited to 400 outbound messages per hour, enforced by our mail infrastructure. This is a per-account, per-hour rolling cap that applies on every plan. You may not create additional accounts on your own domains for the purpose of bypassing this limit. Forwarders count toward the same limit.

Each plan also includes a storage cap shown on your plan page. If your usage approaches the cap we'll notify you before any hard enforcement kicks in. Sustained abuse of the AUP, including patterns that look like a list send or bulk blast, may result in plan changes, suspension, or termination.

Payment

  • Subscriptions can be billed monthly or annually in advance through Stripe. You pick the interval at checkout and can switch later from the billing portal.
  • Plans renew automatically until canceled.
  • You can cancel any time from the dashboard. Cancellation takes effect at the end of the current billing period.
  • 30-day money-back guarantee. If you cancel within 30 days of your first paid charge, you can request a refund from your dashboard settings. We may decline to issue a refund for accounts terminated for violation of the Acceptable Use Policy. The guarantee does not cover AUP-related incident fees (for example, a $2-per-email charge for intentional unsolicited marketing, of which $1 is the pass-through cost from our infrastructure provider and $1 is our incident-response fee, as described in the Acceptable Use Policy).
  • You authorize us to charge your saved payment method for the subscription you select and for any AUP-related incident fees as they are assessed. AUP-related incident fees are charged to your payment method on file when we confirm a violation. The charge appears on your Stripe invoice history.
  • Annual subscriptions are billed in full at the start of each yearly cycle. The 30-day money-back guarantee covers your first annual charge. After 30 days, annual subscriptions are non-refundable but you can cancel any time to stop the next year's renewal.
  • After 30 days, refunds are not offered, but you can cancel any time to stop future charges.
  • If payment fails, we'll retry a few times. After repeated failures the subscription is suspended; mail flow stops until payment is restored.

Your content

You own your email content. We don't read it, scan it, or train ML models on it. We process it only to deliver and store it as part of the Service. See the Privacy Policy for full detail.

Service availability

We aim for high uptime but don't guarantee uninterrupted service. We may perform maintenance and may rely on third-party subprocessors (listed in our Privacy Policy) whose downtime can affect ours. We're not liable for losses caused by outages.

Upstream provider obligations

Our mail infrastructure is provided by MxRoute, a service of TuxByte, LLC, and your use of MailSprout is subject to MxRoute's terms in addition to ours. We pass through MxRoute's restrictions and enforcement actions, including:

  • Per-account hourly sending limit (400 messages per hour). Not configurable.
  • Recipient-initiated spam reports trigger an automatic per-recipient outbound block that we cannot override.
  • Penalty fees for intentional spam. MxRoute currently bills $1 per email for intentional unsolicited marketing. If MxRoute assesses such a fee against your activity, we bill it back to your account at $2 per email ($1 upstream + $1 for our incident response), as described in the Acceptable Use Policy.
  • Chargeback handling. Opening a payment dispute with your card issuer triggers immediate termination of service.
  • Data sharing for fraud and spam enforcement. MxRoute uses FraudLabs Pro to screen signups and shares account information with FraudRecord.com in cases involving intentional spam or billing chargebacks. See our Privacy Policy for details.
  • Backups are courtesy, not contractual. Our mail backend keeps frequent backups but does not guarantee restoration. We recommend customers who need a hard backup guarantee maintain their own local email archive using their email app (Apple Mail, Outlook, etc.).

Termination

You can delete your account any time. We may terminate or suspend your account immediately for material breach of these terms, suspected illegal activity, or if required by law. On termination you have 30 days to export your data; after that we permanently delete it.

Warranties & disclaimer

The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from these terms or your use of the Service is limited to the amount you paid us in the 12 months immediately preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.

Indemnification

You agree to indemnify us against claims arising from your violation of these terms, your use of the Service in violation of law, or your infringement of third-party rights.

Governing law

These terms are governed by the laws of the State of Florida, USA. Disputes are subject to the exclusive jurisdiction of state and federal courts located in Hillsborough County, Florida.

Changes

We may update these terms. Material changes will be emailed to active subscribers at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
